1. GENERAL INFORMATION

1.1 Welcome to our website www.beerwulf.com (the ‘Website’). The Website is provided by Beerwulf B.V. (‘Beerwulf’).

1.2 These terms and conditions (the ‘Ts&Cs’) apply to your use of the Website and your purchases of any products listed on the Website, including but not limited to alcoholic beverages, the SUB appliance, SUB kegs (otherwise referred to as TORPS), the Blade appliance, packaging and/or accessories (the ‘Products’). These Ts&C’s apply to customers purchasing our Products, who are not acting for purposes in connection with any business, company, trade or professional activities (‘B2C Customer‘).  Our Products are therefore not intended for resale purposes.

1.3 If you are a business-to-business customer and/or are intending to purchase our products for resale purposes, we reserve the right to implement whatever means necessary to preclude you from purchasing our Products.

1.4 Please read these Ts&C’s carefully before you submit your order. By using this Website, you confirm that you accept these Ts&Cs and agree to comply with them. If you do not agree to these Ts&Cs, you may not use the Website.

1.5 The purchaser’s own terms and conditions are expressly declared inapplicable.

1.6 We reserve the right to block any users from using our Website or payment system should you breach these Ts&Cs in any way.

 

2. CONDITIONS OF SALE

2.1 MINIMUM AGE FOR ALCOHOL CONSUMPTION

2.1.1 We only sell and supply Products to persons who have reached the minimum age of 18 years. In the United Kingdom, it is an offence to purchase or attempt to purchase alcohol if you are under the age of 18. As such, the purchaser, recipient and consumer of Products ordered on the Website must be 18 years old or over.

2.1.2 We have incorporated various age checks in the order process to ensure that we comply with our legal obligations and we reserve the right to decline or cancel your order at any time if we have reason to believe that you or the recipient or the person consuming the Products do not satisfy the minimum legal drinking age requirement.

2.2 OUR PRODUCTS

2.2.1 Our Website is intended to exclusively promote our Products in the United Kingdom, including Northern Ireland.

2.2.2 Our Products are suitable for consumption. We warrant that the Products we supply conform to the description on the Website and the labelling of the Products, are of good quality and comply with all legal requirements. We disclaim any and all other warranties, whether express or implied in relation to the Products, to the fullest extent permitted by law. Any disclaimer under these Ts&Cs does not affect your legal rights for faulty or mis-described goods.

2.2.3 We recommend that the Products are stored in a dry place, are not exposed to direct sunlight or rain, and are not stored at temperatures below freezing or in an open environment.

2.2.4 The Products sold to B2C Customers are intended for end-users and not for resale.

2.3 ORDER PLACEMENT AND ACCEPTANCE

2.3.1 You can place an order by selecting the desired Products, entering the required details and following the instructions on your screen in the order process. During the order you can check the details and correct any errors before you submit the order. In each phase of the order process please take time to read and check the details of the order as details can no longer be changed once the order is placed. During the order process, products are not reserved until payment has been processed.

2.3.2 If you have any questions about the T&Cs and/or the order process, please contact us before you place an order.

2.3.3 When you are ready to order, you can go through the order process and place your order by clicking the ‘Pay’ button on the order page. Once you have clicked ‘Pay’, you can no longer change your order. You will then be transferred to the payment page to make your payment.

2.3.4 After you have completed the payment on the payment page, you will receive an e-mail confirming that you have placed your order (the ‘Confirmation e-mail’). The Confirmation e-mail contains details of your order, such as the Products and the prices (including shipping charges and tax), plus any other additional information on the order, if applicable. Keep this Confirmation e-mail or print it for your records. If you do not receive a Confirmation e-mail by the next working day after placing your order, please contact us.

2.3.5 The contract between you and Beerwulf comes into force when you receive the Confirmation e-mail. You cannot transfer your rights under the contract or these Ts&C’s without our approval.

2.3.6 We reserve the right at any time to cancel your order for any reason.

2.3.7 If your order has been cancelled, we will inform you as soon as possible and the money you have paid for the Products will be refunded to you as soon as possible (no later than fourteen (14) days after cancellation).

2.3.8 Orders for our Products can only be placed via our Website and not via any other means. We reserve the right to, at any time, implement a cap on the number of Products ordered aswell as the overall value of the order.

2.4 PRICES AND PAYMENT

2.4.1 All prices and charges such as shipping charges on the Website are in pound sterling (GBP) and include VAT and duties.

2.4.2 The prices of the Products are those shown on the order page of the Website when you place the order. The prices shown may be amended from time to time without notice. However, such price amendments will not apply after we have accepted your order. If we accept and process your order when a clear and undeniable error has been made in the pricing, we are entitled to cancel your order, refund any money paid and request you to return any supplied Products to us. The costs of shipping the Products will be borne by us. In any case, it will be subject to Section 2.6 Returns and Cancellation.

2.4.3 You can only pay for the Products using the payment methods shown on the Website. We do not accept any other payment method. If you are using a discount code for payment, please note that you may only use one discount code for each order, unless specifically mentioned otherwise, multiple discount codes cannot be combined.

2.4.4 All payment orders are processed through an external payment services provider. These payment orders are subject to the terms and conditions of the provider concerned.

2.4.5 By paying for an order with Paypal, a credit or debit card you declare that you are the holder of the ‘card’ used. 

2.4.6 All cardholders will be verified and the issuer of the card will be asked to provide an authorisation check. If your card issuer does not authorise the payment to us, we cannot accept your order. In that case we cannot be held liable for any delay or non-delivery.

2.5 DELIVERY INFORMATION

2.5.1 We deliver throughout the United Kingdom, including Northern Ireland. No orders will be delivered to places outside of these jurisdictions. We reserve the right to amend these jurisdictions at any time.

2.5.2 Charges may be levied to deliver your order. These depend on the amount of your order. The delivery charges are shown here on the Website and are also displayed during the order process and in the Confirmation e-mail.

2.5.3 Please note, no deliveries are made on Sundays and Mondays. This may however vary from time to time. During the checkout process on the Website you can indicate your required delivery date. Once the order has been placed, you will no longer be able to change the delivery date. We will do our best to adhere to the required delivery date. However, if it is not possible to meet the delivery date or if there are delays, we will inform you of the expected delay in delivery on the Website, by e-mail, in the Confirmation email and/or via the tracking information of the Carrier.

2.5.4 Your order will be delivered by Yodel or DPD. On the scheduled delivery date your chosen carrier will send you an e-mail with a Track & Trace link, enabling you to track your parcel. Additionally, you may consider to download the relevant app. You may find additional information and extra options about your delivery via the app. Please note that the use of these services and products will be subject to the separate terms and conditions of Yodel or DPD, which we recommend that you review in advance. We will not be held liable for delayed or incorrect deliveries.

2.5.5 Orders will be delivered to the address specified by you when placing an order. We will not be liable for any incorrect information provided by you. You may also specify a different recipient for delivery of your order. You acknowledge that any acceptance by you, a nominated recipient, or by anyone else who accepts delivery on your behalf at the specified delivery address, will be classified as evidence of successful delivery having been made, at which point the Products become your responsibility. Should you appoint any other delivery service provider or any other party to accept the Products at the specified delivery address provided to us, we will not be held liable for any damages, breakages or the like that may occur after delivery.  

2.5.6 Persons receiving a delivery of alcoholic products must have reached the minimum legal age for alcohol consumption. The delivery driver may ask for the person’s age and proof of identity. The delivery driver may refuse to deliver the Products if no valid proof of identity is shown.

2.5.7 If there is no one at home, or if there is no adult who can receive the Products, the delivery driver will take back the parcel and leave a “Delivery Attempted” card in your letterbox. This card has the details of the options available to you. You will be able to communicate your redelivery preferences via the Yodel or DPD App or website. The carrier may also try to leave the parcel with your neighbours, where possible. Our delivery partner will attempt (in total) three deliveries before the item is returned to us or to a local depot for you to collect the parcel.

2.5.8 The above-mentioned age check also applies to choosing other delivery and collection methods and locations.

2.5.9 Please check that the Products received are correct and correspond to your order. Otherwise, please contact us to inform us within thirty (30) days.

2.6 RETURNS AND CANCELLATION

2.6.1 If you wish to return your purchase because you are not happy with the Product or it is faulty or mis-described, you must inform us no later than thirty (30) days after the order has been delivered. This time period does not affect your statutory rights for faulty or mis-described Products. You can contact us with the standard withdrawal form.

2.6.2 If within the first 30 (thirty) days of delivery of the Product, you find the Product to be faulty or mis-described, we will issue you with a refund within 14 (fourteen) days of us receiving the Product(s) at our warehouse.

2.6.3 If within the first six (6) months of delivery of the Product, you report the Product to be faulty or mis-described, if we are able to repair or replace the Product, you will not receive a refund.

2.6.4 If within the first 6 (six) years of delivery of the Product, you find that the Product is faulty, we will repair or replace the Product only if you are able to prove that the fault existed at the time of delivery.

2.6.5 If you would like to cancel your purchase, please use the contact form provided here, as soon as possible. We will try our best to assist. However, if the order has already been dispatched you will need to use the returns procedure stipulated above. We reserve the right to maintain a discretion in this regard. As soon as the cancellation has been confirmed, we will refund you within 14 days of us receiving the Product(s) at our warehouse.

2.6.6 There is a 30-day “cooling-off” period after the order has been delivered in which you may return the Product for any reason. For "Promo" products purchased at a reduced price with short BBD (best before date) this cooling off period is 14 days. The product must be unused and in its original packaging.

2.6.7 We also use our delivery partners for product returns to our warehouse. After contacting our customer services about returning your shipment, we will schedule a collection of the Products via e-mail. Yodel & DPD allow for next (working) day pickup, and can schedule pickup dates until one (1) week later. The packages can only be picked up between 07:30 a.m. to 5:30 p.m. on the day requested. Due to the daily changing delivery routes of the carriers, the exact time cannot be scheduled beforehand. You will be updated via SMS if you have provided your mobile phone number on the day the pickup is scheduled. The Products must be returned no later than fourteen (14) days after you give notice of cancellation.

2.6.8 We will refund the price you paid for the Products together with any shipping charges you have paid to receive the Products. We will bear the cost of any returns made through the Yodel or DPD return services. Please note, if you choose to use another delivery method or provider, you shall be responsible for the costs of returning the Products. If you choose to use another delivery method or provider, any damages caused to the Products during the return process shall not be Beerwulf’s responsibility and any costs arising as a result of the damages shall be borne by you. If you have purchased a Refurbished BLADE, the same rule applies but as they are only sold in bundle formats, we ask that you return both additional kegs with your order to recieve the full refund. 

2.6.9 We will refund the amounts concerned as soon as possible, but no later than fourteen (14) days after the return of the Products to our warehouse, using the same payment method as that used to pay for the order. However, we may delay the refund until we have received the products or proof of return shipment from you, whichever is earlier.

2.6.10 The right to return does not apply to sealed Products which were unsealed after delivery, due to health protection or hygiene reasons and we will not accept return of such Products. We may make a deduction from the reimbursement for any loss in value of any Products supplied to you, if the loss is the result of unnecessary handling or damage by you.

2.6.11 Please note that for all our Products, we can only accept returns if they are unused and in original condition and packaging. 

2.6.12 Please note that Products purchased on promotion or special offer will be subject to these Ts&Cs and any other terms and conditions of the promotion or special offer. Refunds will be made at the offer price, taking into account any discounts applied.

2.6.13 More information on how to cancel an order and use your rights can also be found in the Confirmation e-mail and on the Delivery & Returns page on our Website.

2.6.14 Nothing in these Ts&Cs affects your statutory legal rights in respect of the Product(s).

2.7 ISSUES WITH APPLIANCES

2.7.1  SUB

  1. If you are having problems with your SUB, please contact us where we will assist you by giving you, for example, troubleshooting tips.
  2. If this does not work we will arrange for the appliance to be collected and sent for repairs which should take approximately 10 – 15 working days, or longer, depending on what the problem may be. Once repaired, the SUB will be returned to you.
  3. If any kegs were damaged while using the faulty SUB, we will compensate up to 2 kegs.

2.7.2 Blade

1. If you are having problems with your appliance, please contact us where we will assist you by giving you, for example, troubleshooting tips.
2. If this does not work we will arrange for the appliance to be collected and sent for repairs which should take approximately 10 – 15 working days, or longer, depending on what the problem may be. Once repaired, the appliance will be returned to you.
3. A Blade repair carries a 6 month guarantee from our authorised repair partner, should the same issue reappear we will send it for repair even if your appliance is outside of the manufacturer warranty.
4. If any kegs were damaged while using the faulty appliance, we will replace up to 2 kegs.

2.8 PRODUCT WARRANTY

2.8.1 Any beer dispensing appliance we sell to you comes with a warranty from its manufacturer. The Blade manufacturer is WIK Elektro-Hausgerate Vertriebs GmbH & Co. Prod. KG. The SUB manufacturer is Groupe SEB Moulinex S.A. (or one of its affiliated companies). For details of the applicable terms and conditions, please refer to the warranty provided by such manufacturer in respect of the relevant appliance. If any beer dispensing appliance sold to you develops a defect while under warranty, or you have any other issue with the product, you should contact us in the first instance. If the applicable terms and conditions are unclear, you may contact us to find out what the manufacturer’s applicable warranty is at that time.

2.8.2 The warranty provided on both a SUB and Blade appliance is 2 years, but Refurbished Blades have a warranty of twelve months from your purchase date as they have been previously used. The repair process for a SUB is outlined in paragraph 2.7.1 above. In relation to a Blade device, if a problem arises within 30 days of purchase, we will replace the appliance with a new appliance free of charge. If a problem arises more than 30 days after the date of purchase, unless you can prove that there was a defect at the time of delivery, we will utilise our repair service to repair your machine. If the appliance becomes defective outside of the 2-year warranty period, we will no longer be liable to repair or replace the appliance. This does not affect your statutory legal rights.

2.8.3 We only warrant Products bought from /ordered through our Website. Please provide us with proof of purchase, such as an order number when claiming the warranty. If you no longer have proof of purchase you will not be able to rely on the warranty.

2.8.4 We disclaim any and all other warranties, whether express or implied in relation to the Products, to the fullest extent permitted by law. Any warranty or guarantee given under these Ts&Cs does not affect your legal rights for faulty or mis-described goods.

2.8.5 Any guarantee or warranty given under this section does not apply to defects in Products which have arisen as a result of fair wear and tear, wilful damage, accident or negligence by you, or any third party, failure to use the Product in accordance with our instructions, expiration past Best Before Date, or alteration or repair carried out on the Product by you without our prior approval.

2.8.6 It is your responsibility to ensure Products are stored in a safe and appropriate manner. Kegs must be stored in a dry place and must not be exposed to direct sunlight or rain, or stored at temperatures below freezing, or outside or in an open environment.  

2.8.7 Shortly after you purchase an appliance, we will will send you an email setting out the maintenance guidelines for that appliance. We will not be held responsible should you fail to follow those guidelines.

2.8.8 We only supply the Products for domestic and private use. You agree not to use the Products for any commercial purposes.

2.8.9 We will not be be held liable for any damage(s) which may be caused to your or your property through improper use of our Products.

2.9 LIABILITY

Our maximum liability in connection with your purchase of Products is an amount equal to the total price paid in connection with your order for the Products. However, nothing in these Ts&Cs shall exclude or limit our liability where it would be unlawful to do so.

 

3. CONDITIONS OF USE OF THE WEBSITE

3.1 PRIVACY POLICY AND COOKIE POLICY

3.1.1 We collect and process personal data from visitors to our Website and persons who enter into a contract with us. We use various cookies on the Website. Our Privacy & Cookie Policy applies to the use of the Website and forms an integral part of these T&Cs.

3.2 INTELLECTUAL PROPERTY RIGHTS

3.2.1 The Website and all its content, functions and functionality (including but not limited to all information, software, text, images, video and audio as well as the design, selection and arrangement thereof) are our property, or the property of our group companies, affiliates, subsidiaries and partners, its licensors or other providers of such material and are protected by copyright, trade marks, patents, trade secrets and other intellectual property or proprietary rights. You shall not, and shall not attempt to, obtain any title to any such intellectual property rights. All rights are reserved.

3.2.2 You can use the Website only for purposes in line with these Terms and none of the material listed in Clause 3.2.1 above may be reproduced, copied, redistributed, republished, downloaded, displayed, posted or transmitted in any form or by any means, sold, rented or sub-licensed, used to create derivative works, or in any way exploited without our prior express written permission.

3.2.3 You must not use any part of the content on our Website for other purposes without obtaining a license from us or from the other rights holders.

3.3 DISCLAIMER

3.3.1 In spite of the continuous care and attention to the content of the Website, we cannot guarantee the completeness and correctness of our Website. We shall not be liable for any damages resulting from the use (or inability to make use) of this Website, including any incorrectness or incompleteness of information placed on the Website. We will only be responsible for any losses that you suffer as a result of our breach and to the extent that they are a foreseeable consequence to both of us at the time you placed the relevant order. Nothing in these Ts&Cs shall exclude or limit our liability for death or personal injury resulting from our breach of contract, tort, fraud or negligence, or for any loss which cannot be excluded or limited by applicable law.

3.3.2 We cannot guarantee that the Website will operate faultlessly and without interruption. We are not liable for any damage that may result from the use of electronic means of communication, including, but not limited to, damages due to slow delivery or non-delivery of electronic means of communication or due to interception or manipulation of electronic means of communication by persons or computer programs used for electronic communication or the transmission of viruses.

3.3.3 The images of the Products on our Website are for illustrative purposes only. Although this Website has been created with the utmost care, it is possible that features of Products (appearance or product information) are not accurately displayed or depicted. In that case the features shown on the packaging of the product itself will prevail. In the event of such a difference, you may return the Product within thirty (30) in accordance with the procedure set out above in Article 2.6 Returns and Cancellation.

3.3.4 The Website contains links to third-party websites. We cannot vouch for the content and operation of these websites. You are advised to read the terms and conditions of those websites. We make every effort to guarantee as far as possible that the Website is free of viruses, but no guarantee can be given.

4.1.2 You may not transfer any of your rights under these Ts&Cs. We may transfer any of our rights or obligations under the Ts&Cs or a contract with you to any one of our group companies from time to time.

4.2 CHANGES TO THESE TERMS AND CONDITIONS

4.2.1 We recommend that you print out these Ts&Cs or save them on your computer for future use and/or review. We may amend these Ts&Cs from time to time without notice. Therefore, whenever you use the Website or order Products, you must read these Ts&Cs again before you order the Products, so that you are always aware of the Ts&Cs in force at that time.

4.2.2 Each of the articles in these Ts&Cs is valid individually. If a court or competent authority rules that one (or part thereof) and/or more articles are invalid or unenforceable, the remaining articles will remain fully in force.

4.3 APPLICABLE LAW AND JURISDICTION

4.3.1 These Ts&C’s and any contract entered into shall be governed and construed in accordance with English law and you can bring legal proceedings in respect of the Products in the English courts. If you live in Scotland, you can bring legal proceedings in respect of the Products in the Scottish or English courts. If you live in Northern Ireland, you can bring legal proceedings in respect of the Products in the Northern Irish or English courts.

4.3.2 If you experience problems with the Products you have purchased on the Website, you can submit a complaint with a view to possible non-judicial dispute settlement via the Website https://ec.europa.eu/consumers/odr/ on the European Commission’s Online Dispute Resolution Platform.
